Without limitation of its obligations and responsibilities under the Purchase Order or at law,Vendor shall maintain for the duration of the Purchase Order the following insurance with a cross liability provision where appropriate and with a first class insurance company,Purchaser and Owner,shall be named additional insured to the extent necessary to provide coverage under Vendor’s insurance for the insured liabilities assumed by Vendor under the foregoing indemnity provisions and such policies shall waive rights of subrogation against Purchaser and Owner,and insurers:
\x05a) Employers Liability Insurance/Workmen’s Compensation with a minimum indemnity and in terms compliant with any applicable legislation covering personal injury to or death of the employees of Vendor engaged in the performance of the Purchase Order and such additional insurance as deemed necessary by Vendor to cover its liabilities.Vendor shall require that its sub-vendor (if any) maintain corresponding insurance in respect of their employees.
\x05b) General Third Party Liability Insurance with an indemnity of not less than three million United States Dollars (US$3,000,000) for any one incident or series of incidents arising from each and every event,unlimited in aggregate,covering all operations of Vendor including among other risks the contractual Liability to third parties assumed herein by Vendor:and
\x05c) Product liability insurance with adequate terms and level of cover having regard to the intended use of the Goods.
Vendor shall insure the Goods,including Free-Issue Items from the time of receipt by Vendor,to their full replacement value in the joint names of Vendor and Purchaser and to the satisfaction of Purchaser against loss,damage or destruction until they leave Vendor’s and/or any Sub-vendors works for transport to the port of delivery (FOB) of the Goods to Purchaser.
Without limitation of Vendor’s obligations and responsibilities under the Purchase Order or at law,if Vendor places and Sub-orders in respect of any part of the Goods,the insurance provisions of each sub-order shall be consistent with the Purchase Order.Vendor shall be responsible for ensuring that sub-orders maintain insurance as required in the sub-orders during the course of the Sub-vendor’s operations.
