Article 28 Delayed payments
28.1 If the period laid down forpayment in the Special Conditions has been exceeded, and the contract has notgiven rise to any claim, the Supplier shall qualify for interest calculated prorata on the basis of the number of calendar days by which payment is delayed,at the rediscount rate of the issuing institute of the State in which the Supplierhas his registered office.

28.2 Any default in payment ofmore than 120 days from the expiry of the period laid down in the SpecialConditions shall entitle the Supplier either not to perform the contract or toterminate it.

ACCEPTANCEAND MAINTENANCE
Article 29 Delivery
29.1 The Supplier shall deliverthe supplies in accordance with the terms specified in the contract and thesupplies shall remain at the risk of the Supplier until provisional acceptance.

29.2 The Supplier shall providesuch packaging of the supplies as is required to prevent their damage ordeterioration in transit to their final destination as indicated in thecontract. The packaging shall be sufficient to withstand, without limitation,rough handling, exposure to extreme temperatures, salt and precipitation duringtransit and open storage. Package size and weight shall take intoconsideration, where appropriate, the remoteness of the final destination ofthe supplies, and the possible absence of heavy handling facilities at all pointsin transit.

29.3 The packaging, marking anddocumentation inside and outside the packages shall comply with suchrequirements as shall be expressly provided for in the Special Conditions,subject to any variations subsequently ordered by the Project Manager.

29.4 No supplies shall be shippedor delivered to the place of acceptance until a confirmation in writing hasbeen obtained by the Supplier from the Project Manager that the supplies may bedelivered. The Supplier shall be responsible for the delivery at the place ofacceptance of all supplies and Supplier's equipment required for the purpose ofthe contract.

29.5 Each delivery must beaccompanied by a statement drawn up by the Supplier. This statement as statedin the Special Conditions.

29.6 Each package must be clearlymarked as stated in the Special Conditions.

29.7 Delivery shall be deemed tohave been made when there is written evidence available to both parties thatdelivery of the supplies has taken place in accordance with the terms of thecontract, and the invoice(s) and all such other documentation as specified inthe Special Conditions, have been submitted to the Contracting Authority. Wherethe supplies are delivered to an establishment of the Contracting Authority,the latter shall bear the responsibility of bailee, in accordance with therequirements of the law of the contract, during the time which elapses betweendelivery for storage and acceptance.
