美国《统一计算机信息交易法》是由美国统一州法委员会通过的一部用于调整计算机信息交易的示范法,强调计算机信息与一般货物相比的特殊性,为数字信息时代的信息交易提供了一个区别于传统法律制度的法律框架.而我国的计算机信息交易立法现状,以计算机软件交易来看,被纳入著作权法保护体系,同时有《计算机软件保护条例》予以特殊保护.但现有立法中存在软件的技术措施应用与著作权法中合理使用制度冲突等矛盾问题,无法很好地调整信息交易.因此,研究信息交易法律,完善相关立法,对发展我国信息产业有重要意义.
二、计算机信息交易法的研究内容
首先,研究计算机信息交易立法的重要性和可行性,着眼于计算机交易立法区别于与传统合同法、知识产权法和物权法保护的特殊性,进行相关立法的研究.其次,明确界定计算机信息的内涵和外延,为更好地调整计算机信息交易奠定基础.最后,研究计算机信息交易中权利义务内容具体制度构建,分析市场许可、信息担保、电子自助人等相关制度在中国是否具有建立的必要性和可行性,以及与现有相关立法协调的问题.
